UPE (Transfer of Undertakings (Protection of Employment) Regulations) is a complex area of employment law, and often a little known or understood area of law. The regulations are not voluntary.
The TUPE regulations seeks to protect employees when a business or part of a business is sold and changes ownership. TUPE also applies when there is a service provision change, for example, when a client who engages a contractor to do work on its behalf is either outsourcing or re-tendering the contract, or bringing it back in-house.
Where the TUPE regulations apply, your employment will automatically transfer to the incoming business or new service provider on your existing terms and conditions and your length of service is preserved.
If you are involved in a TUPE transfer, it may be prudent to seek advice if your current or new employer is seeking to vary your terms and conditions of employment or terminate your employment in connection with the transfer.
